Vismart Four Wheels Car Rental – Terms & Conditions

1. Rental Agreement

The vehicle is rented to the Hirer subject to the terms outlined in this agreement and the details stated in the rental booking or hire agreement form. The Hirer accepts full responsibility for the vehicle for the entire rental period.

2. Minimum Rental Period

The minimum rental period for all vehicles is three (3) consecutive days. Rentals for a shorter duration will still be charged at the minimum three-day rate.

3. Booking Confirmation & Deposits

3.1 Booking Deposit

• A non-refundable booking deposit of 30% of the total rental amount is required to confirm any reservation.

• A booking is not considered confirmed until the 30% deposit has been received by the Company.

• The balance of the rental amount must be paid before or at the time of vehicle delivery, unless otherwise agreed in writing.

3.2 Damage Security Deposit

• A damage security deposit of at least 20% of the total rental amount is required.

• The damage deposit is separate from and in addition to the 30% booking deposit.

• This deposit is held as security against damages, loss, traffic fines, cleaning charges, fuel discrepancies, or any other costs incurred during the hire period.

• Subject to inspection, the damage deposit will be refunded within a reasonable period after the vehicle is returned, less any applicable deductions.

4. Payments

All rental charges, deposits, extensions, penalties, or additional costs must be paid in full as agreed. The Company reserves the right to charge outstanding amounts using the payment method provided by the Hirer.

5. Cancellation & Refund Policy

5.1 Cancellations by the Hirer

• Cancellations made more than 10 days before the rental start date are eligible for a refund of the booking deposit, less applicable administrative charges.

• Cancellations made between 7 and 10 days before the rental start date will attract a cancellation fee, and only a partial refund may be issued.

• Cancellations made within 7 days of the rental start date will attract a cancellation fee of up to 95% of the booking amount.

• No-shows or failure to collect the vehicle at the agreed time will result in no refund.

5.2 Early Termination

• Returning the vehicle before the agreed end date does not guarantee a refund for unused rental days.

• Any refund for early termination is at the sole discretion of the Company.

6. Authorized Drivers

• Only the Hirer and any additional drivers listed and approved in the rental agreement are permitted to drive the vehicle.

• All drivers must hold a valid driving licence recognized in Kenya and meet the Company’s age and experience requirements.

7. Use of Vehicle

The Hirer agrees that the vehicle shall:

• Be used only for lawful purposes.

• Not be sub-hired, sold, or used for hire or reward without prior written consent.

• Not be driven by unauthorized persons.

• Not be driven under the influence of alcohol, drugs, or any illegal substances.

• Not be used off-road, on rough terrain, flooded roads, or restricted areas unless explicitly authorized.

8. Hirer’s Responsibilities

The Hirer is responsible for:

• Maintaining fuel, oil, coolant, and tyre pressure levels.

• All traffic fines, parking penalties, toll fees, and impound charges incurred during the rental period.

• Keeping the vehicle clean and in good condition.

• Returning the vehicle with the same fuel level as at the start of the hire.

9. Insurance

• Vehicles are insured in accordance with Kenyan law and subject to the insurer’s terms and conditions.

• Insurance cover may be void if the vehicle is misused, driven negligently, or operated in breach of these Terms.

• The Hirer remains liable for uninsured losses, excess amounts, and exclusions including tyres, glass, underbody damage, and loss of use.

10. Accidents, Breakdown & Theft

• Any accident, breakdown, or theft must be reported to the Company immediately.

• A police abstract is mandatory in the event of an accident or theft.

• The Hirer shall be responsible for recovery, towing, and related costs unless otherwise covered by insurance.

11. Smoking & Cleaning

• Smoking is strictly prohibited in all vehicles.

• A minimum cleaning fee of KES 3,000 will apply if the vehicle is returned smelling of smoke or excessively dirty.

12. Return of Vehicle

• The vehicle must be returned on the agreed date, time, and location.

• Late returns may attract additional charges.

• Vehicles returned to a different location without authorization will incur relocation costs.

13. Limitation of Liability

The Company shall not be liable for any loss, delay, or damage to personal belongings left in the vehicle during the rental period.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

By proceeding with a booking, the Hirer confirms that they have read, understood, and agreed to these Terms and Conditions.
